1. Every item sold "as is, where is." No warranty implied or otherwise exists in relation to any goods offered for the sale unless otherwise announced at the sale.
Kastner Auctions Auctioneering are agents only for the seller.
No guarantees whatsoever.
2. Settlement in full must be made on sale day. Full payment must be received before any goods are removed from the premises.
3. All goods are available for inspection before the sale and each purchaser shall be held to have satisfied themselves as to identity, authenticity, and condition and shall not be permitted to make any objection after the sale on any grounds whatsoever.
Bidder whether acting as principle, agent, officer or director of a company or otherwise, in any capacity whatsoever, and the company he represents, both jointly and severally agree:
A) To indemnify save harmless Auctioneers and its consignors ("Consignors") from any and actions, causes of action, suits, damages, costs and losses of any nature arising from the attendance or participation of Bidder, his agents or employees, at the auction sale and/or on the auction site whether before during or after the auction sale;
B) To be responsible for the payment of the purchase price and taxes plus all applicable fees due on all Bidder's Purchases;
C) No purchasing on behalf of Consignor
4. Goods not paid or not removed from the premises on sale day may at the option of the auctioneer be resold at any subsequent sale and any deficiency charged to the purchaser.
5. Goods left on the premises may at the option of the auctioneer become liable for storage or removal charges and any goods so stored or removed may be resold or disposed of immediately by auctioneer and any costs or deficiency charged to the purchaser.
6. The auctioneer reserves the right to accept or reject any bid and in cases of dispute, the auctioneer's decision shall be final.
7. The auctioneer does not warrant any of the good to be free and clear of encumbrances but only that he has obtained a statutory declaration of liens and encumbrances from consignors. The auctioneer further warrants the he will pay sale proceeds less commissions towards goods declared by the consignors thereof to be subject to liens or encumbrances.
8. All sales are final. All items are subject to a 15% ONLINE buyer's premium. G.S.T. applies to all sales. If for any reason, Auctioneers are unable to make available or deliver and Purchase or clear title to the same, or documentation required in respect of any Purchase, whether before or after delivery, Auctioneers' sole liability, if any shall be the return of monies paid in respect of such Purchase price only, upon its return by the purchaser. Any such Purchase shall be returned or surrendered upon demand of Auctioneers after 7 days a 5% per month depreciation will be deducted from the original price.
9. Goods left on the premises 6 business days after the auction will be charged $6.00 per day per item for storage or $10.00 per vehicle per day for storage.
10. All vehicle sales will receive a minimum of $300.00 deposit on sale day. Vehicles will be paid in full the next business day after the auction date on which it was purchased.
Credit cards will be accepted up to a maximum of $3000 towards the total price of a vehicle(s).
Description as to condition or otherwise is in no way a warranty or guarantee actual or implied. Neither the auctioneer nor the owner are responsible for any errors in description or condition. We do not guarantee mileage.
Visually inspect to determine if odometer is in kilometers or miles as may not be noticed.
Storage will be charged after four (4) days.
11. Goods sold to a purchaser lie at their risk instantly. Any subsequent damage, including any caused by the auction staff during loading is solely at the buyer's risk.
12. We do not guarantee mileage/hours. Bidder confirms we have asked them if they would like to receive future emailings from Kastner Auction's about upcoming auctions and liquidation deals.

Shipping is at the responsibility of the buyer. Small Items will be shipped by Canada Post after items have been verified.
Larger items (larger than parcel size) will be shipped by the freight line determined by the buyer of the assets. all shipping arrangements must be made with in 24 hours of auction and all assets MUST be picked up or shipped with in 72 hours of online auction finish time. all shipping costs will be charged to the buyer or charged collect.
Kastner Auctions does not ship any alcoholic items(lots).
-All items need to be picked up within 5 days of purchase.
-All items left after that time are subject to a $6 per day per item storage fee.
-All items left for 21 days or longer are considered forfeited.
-No refunds will be issued for forfeited items.

Vehicle Payment Terms:
1.Vehicles are charged a maximum of $750 buyers premium.
2.Vehicle purchases over $3500 will be paid by debit, cash or bank draft Only, (credit card payments will not be accepted over this amount)

-All items left after that time are subject to a $6 per day per item storage fee.

Accepted Payment Methods:
Live auctions will be subject to a 15% buyers premium (unless otherwise noted). Also note some items will be subject to a handing fee. (Glassware that must be packed, pictures that must be wrapped, etc etc.) If shipping is not arranged within 72 hours the buyer agrees the auctioneer may auto ship all items at the buyers expense.
Online bidding during the Live Auction is a fast process, and therefore there is no confirmation given - bids will be taken immediately and are irrevocable.
The highest bidder shall be the purchaser upon the completion of bid verification. Bid verification will commence upon the conclusion of a live auction and may last 24 hours. All winning bidders shall be notified by email within the 24 hour bid verification period.
No bidder shall retract their bid. In the event of a dispute between two or more bidders, the auctioneer, at his sole discretion may put the lot up for resale to the highest bidder.
A bidder is deemed to have accepted an item when making a bid.
The auctioneer reserves the right to withdraw any lot at any time prior to the time of sale of such lot.
The auctioneer reserves the right not to accept any bid which is only a partial advance over the preceding bid.
The auctioneer may break down or consolidate any lot or lots at his sole discretion.
Kastner Auctions Limited assumes no responsibility for any liability once a bid is accepted. It is recommended that purchasers arrange insurance for their purchases in advance.
Except as set out herein, there shall be no warranties or guarantees expressed or implied, statutory or otherwise of any nature.
Please take advantage of in person preview as all items are sold "As Is, Where Is" - catalogues are prepared only as a guide. No sale shall be invalidated by any reason or defect or inaccuracy of description in catalogue or otherwise, and no liability shall be borne by the auctioneers by virtue of any such fault or error. All sales final.
Attendance at the auction, preview, or removal by bidders and guests is done at their sole risk. Kastner Auctions assumes no risk or liability, statutory, common law or otherwise whatsoever for the safety of those attending at the auction premises.
All lots must be paid for on day of sale by Money, cash or credit card where acceptable. Internet bidders shall have within 24 hours upon receipt of their email notification to pay for their items.
All applicable excise and sales taxes shall be added to the purchase price.
The purchaser is not entitled to possession until all items have been paid for in full. In the event that the purchase prices are not paid within the prescribed time, the auctioneer shall have the right to resell such items in whatever manner he sees fit without notice to the purchaser. Any shortfall from sale plus commission and expenses thereof shall be paid by the purchaser.
All costs and responsibilities of removal shall be borne by the purchaser/bidder within the time prescribed by the auctioneer. The auctioneer may require proof of adequate insurance from the purchaser. The purchaser/bidder herby indemnifies the auctioneer and the vendor against any and all damages arising from the dismantling and removal of any lots.
Any lots not removed within the prescribed time shall be subject to storage, moving, disposal and service charges at the sole risk and expense of the purchaser. All such lots shall be deemed as abandoned and shall be subject to resale for the recovery of such charges. The purchaser shall also be liable for any rent or damages sustained by the auctioneer for failure to remove any lot.
If for any reason, Kastner Auctions Ltd is unable to deliver any or all of an awarded lot or title thereof, the sole liability of Kastner Auctions Ltd shall be the refund of any monies paid on the lot.
It is the sole responsibility of the purchaser to remove their items within the prescribed time. Kastner Auctions Ltd will NOT provide any delivery or transport of any nature for live auction items.
