This model miniature was created in 1938 by MGM studios and used in the filming of one of the most iconic moments in cinematic history: the twister scene from the “Wizard of Oz”. Props from this iconic film are some of the most coveted items of Hollywood memorabilia and are very rare. This model has never been to auction before. It was sold in 1970 to a private collector by the former head of MGM. The model has impeccable provenance. The prop was authenticated in 1973 by the person in charge of special effects for the 1939 film, Arnold Gillespie (also known as the “Wizard of MGM”). Mr. Gillespie was a legend in the field of special effects. He swore an Affidavit confirming the authenticity of the model. According to Mr. Gillespie, this model was one of three used in the filming of the twister sequence and was the only to survive production. His Affidavit has been authenticated by his grandson, Robert Welch. Mr. Welch edited Mr. Gillespie’s book on special effects and is himself an expert on the Wizard of Oz. It is extraordinarily detailed, which along with its design and construction is consistent with industry standards and practices at the time. The house is constructed of different types of hardwood and each roof shingle was meticulously cut in accordance with how these types of models were made almost 100 years ago. The small holes on the top of the miniature where wire was inserted to control the prop while falling and spinning are present. The miniature was formed with horse hide glue which was the type used during the period for construction of models. Inside the miniature is an MGM property tag. The model is constructed on a scale of ½ inch to a foot. 13.5"x14.5"x12.5” Please see the full length video on our web site regarding the provenance of the miniature. In addition to the original Affidavit of Arnold Gillespie, the miniature comes with a letter of authenticity from noted film historian Marc Wanamaker. Also included is the original MGM receipt and inter-office memorandum regarding the sale in 1970 to the private collector. The model also comes with a custom made acrylic case and stand which simulates the position of the house during the iconic filming scene. These Terms and Conditions of Sale (“Conditions”) set out the legal relationship between the Bidder/Buyer and Studio Auctions and the Seller. By applying for Bidder registration and by placing a bid at our auction, a Bidder is deemed to have read and accepted to be bound by these Conditions. Studio Auctions acts as agent for the Seller. Online bidding at our auctions is made available via third party service providers and use of their services and all online bidding is subject to their respective terms of use.
When making a bid, every Bidder acknowledges that such bid is a binding offer to buy the Lot at that price (plus the Buyer’s Premium and other expenses reasonably related to the Lot e.g. shipping and taxes). Estimates are simply a guide and should not be relied upon as to advice on value or the ultimate Purchase Price, which could be significantly higher.
A commission of 20% (plus taxes if applicable) of the Hammer Price for a Lot, is payable by the Buyer to Studio Auctions in addition to the purchase price and any other expenses reasonably related to the lot. The buyer is responsible for all fees including duties, taxes, customs and other charges for items shipped. Buyer understands and agrees that Studio Auctions shall have no obligation or responsibility for complying with any export procedures, regulations, or laws applicable to the property.
Studio Auctions will notify successful Bidders and send (by email) a payment invoice setting out the Purchase Price and itemising the Hammer Price, Buyer’s Premium and other expenses reasonably related to the Lot that the buyer is responsible for within 7 working days of the end of the Auction. Payment is due within 7 working days from receipt of invoice. Payment must be in U.S. funds and may be made by electronic transfer, debit card, credit card (up to a maximum of $10,000) or bankers draft or cash (up to a maximum of $5,000). Please note that the Credit Card Fee will be charged and payable in addition to the Purchase Price on any amounts paid by credit card. Credit card payments are only acceptable on the express understanding that the Lot is not returnable, refundable nor exchangeable. By registering for this auction the Buyer authorizes Studio Auctions to charge the credit card provided at registration for all Lots purchased at the auction, and any future auction a Bidder may participate in, if not paid in full within 7 calendar days after the auction close.
Risk and responsibility for the Lot passes to the Buyer seven calendar days from the date of the sale or on collection by the Buyer if earlier and the Buyer should arrange insurance cover for the Lot if required. The Buyer shall collect or collected for shipment, purchased Lots within 7 calendar days from the date of the sale unless otherwise agreed. Lots can be collected in person by appointment only. Each Lot will require a custom packing service. Although Studio Auctions shall use reasonable efforts to take care when selecting third parties for these purposes, the Buyer will contract directly with such third party and Studio Auctions accepts no liability or responsibility for the acts or omissions of any such third parties.
In the event of default by the Buyer, Studio Auctions may take one or more of the following actions: hold the Buyer liable for the total amount due and commence legal proceedings for its recovery together with interest, legal fees and costs to the fullest extent permitted under applicable law; cancel the sale; resell the Lot publicly or privately on such terms as Studio Auctions shall think fit; set off against any amounts which Studio Auctions may owe to the Buyer in any other transactions, some or all of the outstanding amount remaining unpaid by the Buyer; apply any amount paid to discharge any amount owed in respect of any particular transaction, whether or not the Buyer so directs.
The nature and age of the Lots means they are often unique and are likely to have wear and tear and damage. By making a bid, the Bidder accepts the actual condition of the Lot. Studio Auctions will make all reasonable efforts to make any description revisions readily available during the Auction. Except as expressly provided in these Conditions Studio Auctions shall have no liability to the Buyer in respect of a Lot and all and any implied warranties and conditions are excluded to the fullest extent permitted by law. Buyers should be aware that multiple examples of props and costumes are frequently used during production and it is often impossible to determine whether a specific prop has been used on-camera. If a Buyer demonstrates, to Studio Auction’s reasonable satisfaction, that an item is not authentic or a description is materially incorrect, the sale will be rescinded if the Lot is returned to Studio Auctions in the same condition in which it was at the time of sale. Repayment of the Purchase Price and Buyer’s premium shall be the Buyer’s sole remedy, to the exclusion of all other remedies to the extent permissible at law. The Buyer expressly agrees that Studio Auction shall not be liable in whole or in part, for, and the Buyer shall not be entitled to recover, any special, indirect, incidental or consequential damages including loss of profits or value of investment or opportunity cost.
The Auction will be recorded and tracked on a video or digital screen and photographs taken. By participating in and/or attending the Auction and signing the registration form, each person consents to be filmed and/or photographed and agrees and authorizes Studio Auctions to use and publish such film and/or photographs, name and likeness for any use Studio Auction deems appropriate.
If any part of these Conditions is found by any court to be invalid, illegal or unenforceable, the rest of the Conditions shall continue to be valid to the fullest extent permitted by law.
These Conditions are governed by California law and all parties agree to submit to the exclusive jurisdiction of the California courts.
