Auction Terms & Conditions
NOTE: Bidders at Effy Live Jewelry Auction acknowledge that they have read and agree to the following terms and conditions of sale and are bound thereby. If you do not understand any of these terms or conditions, please ask an Effy Ambassador for clarification before registering.
1. Identification - All purchasers are required to have signed up and registered to bid and shall supply Effy Live Jewelry Auctions with their full name, address, email address and telephone number. To be a registered bidder, participants must sign up no later than 12 hours prior to the auction start time. Bidders may be required to provide photo identification. We retain the right to exclude any bidder that has provided false contact information.
2. The auctioneer has the right at his absolute discretion to refuse any bid. The highest bidder shall be the buyer at the hammer price. The decision of the auctioneer shall be final and absolute As a Bidder, placing a bid is a binding contract between you and Effy and the bid cannot be retracted. Once you place a bid, and if you win, you will be obligated to buy the product at the said price you indicated as your bid. Placing a bid on this Site, and winning, then not paying for the product is illegal in most states, and prosecution can result.
3. Manner of payment - All lots are to be paid in full by cash, approved check, Mastercard, Visa, American Express, Debit Card or other pre-approved form of payment before at the close of the auction. An Effy Ambassador will contact you via phone to settle your invoice payment. Effy Live Jewelry Auction reserves the right to hold merchandise until a buyer’s check clears and reserves the right to not accept a check. There will be a $15.00 service charge for any check returned from the bank for any reason.
4. New York State Tax – all purchases made in the state of New York will be subject to New York Sales Tax based on specific county rates.
5. All measurements and sizes - are approximate.
6. Minimum bids – will be placed on all items.
7. All lots - to be sold as is and all sales are final. Make sure to read and understand a listing’s description and buyer qualifications before you bid.
8. Auctioneer cannot, and will not, be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void any sale, temporarily suspend bidding and re-sell any item/lots that were affected by any malfunction. The decision of the Auctioneer is final.
9. Additional terms and conditions - Any additional terms or conditions of sale, added by auctioneer, shall be announced prior to auction.
10. Warranty - Effy Jewelry stands by the quality and craftsmanship of each product sold, and we are pleased to offer a Limited Lifetime Warranty. Your original receipt is required for all warranty service. We agree to repair or exchange any items that we deem to be damaged due to a manufacturing defect. This Warranty expressly excludes coverage for excessive wear and tear; physical/ accidental abuse; loss (including loss of stones); and theft. Any repair or service performed by anyone other than Effy Jewelry will immediately void the warranty.
11. You agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy the Site or the content contained herein without our prior, express written permission. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any activity being conducted on the Site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You agree that you will not copy, reproduce, alter, modify, create derivative works, or publicly display any content from the Site without prior, express written permission of Auctioneer. THE SITE IS PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPOSED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights which vary from state to state.
12. RETURN & EXCHANGE POLICY- Exchanges will be made in the case of damage due to a manufacturing defect; no returns will be accepted for refund. The original sales receipt is required for all exchanges. All exchanges must be in “as new” salable condition. No damaged, sale, discounted, altered, “as is” or special/ custom order merchandise is exchangeable. All original packaging must be included. No exchanges will be accepted after 30 days from the original purchase date. All exchanges must be authorized by our New York-based Customer Care Department prior to being accepted. The Customer Care Department reserves the right to verify the authenticity of the product prior to accepting any exchange. This receipt supersedes and nullifies any prior agreements, written or verbal, made between you and any representative or employee of Effy Jewelry. Effy jewelry is not responsible for any taxes or duties for special orders or repairs shipped to the customer.
13. UPGRADE POLICY - Effy Jewelry offers a lifetime upgrade policy on all diamond jewelry as well as loose diamonds purchased from any Effy retail store. While on your vacation or cruise, we encourage you to take full advantage of this policy. Upgrades will be honored only if the purchase price is equal to or greater than twice the amount of the original purchase. The original piece must be in new condition and must be accompanied by your original receipt.
14. Any controversy or claim arising out of or relating to this Site User Agreement shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Manhattan, New York, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Auctioneer may seek any interim or preliminary relief from a court of competent jurisdiction in New York, necessary to protect the rights or property of Auctioneer pending the completion of arbitration. You and Auctioneer are independent contractors, and no agency, partnership, joint venture, employee or franchiser-franchisee relationship is intended or created by this Agreement. The Site User Agreement and any disputes arising out of or related to the Site shall be governed by and construed and enforced in accordance with, the laws of the State of New York applicable to contracts entered into and to be performed entirely within the State of New York. If any provision of this Site User Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Auctioneer’s failure to act with respect to a breach by you or others does not waive the right to act with respect to subsequent or similar breaches. This Site User Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.
15. Live auction bid credits will remain available at the full issued amount for the duration of the respective auction catalog being open.
16. At the close of the respective auction catalog and remaining live auction bid credits will be deposited into the Auction Wallet at the rate of 50%.
17. Once deposited into the Auction Wallet the credits will remain available for 30 days post deposit date.
18. Any bid credit being applied to a purchase will be applied at the time of payment directly by the Gallery Curator and/or billing department.
19. Any accrued bid credits to be applied cannot exceed $500 or 30% of the purchase price, whichever is greater.
